Terms & Conditions for booking:
RETAINER AND PAYMENT: Full payment is due within 7 days
before booking.
CANCELLATION AND RESCHEDULING: A $50 non –refundable deposit
will be taken & can be used towards future sessions.
Full refunds will not be issued. Sessions can be rescheduled up to 48 hours
prior to the event. After this, they cannot be rescheduled. I cannot guarantee
availability to reschedule. Occasionally, I may need to reschedule the photo
session date (for example, weather conditions and events outside my control)
and, in such event, I will give you as much notice as possible. I will use
reasonable endeavors to reschedule the photo session to a date that suits you,
but cannot promise that an appropriate date will be available. Rescheduled photo
session dates may not be cancelled.
ARTISTIC RIGHTS: The Photographer retains the right of
discretion in selecting the photographic materials released to client.
COMPLAINTS: I endeavor to address any concerns or complaints
you may have as quickly as possible. Please address concerns or complaints to
me in writing at beckylbranch@gmail.com
EVENTS OUTSIDE MY CONTROL: If I am prevented or delayed from
carrying out the photo session by an event outside my control (including acts
of god, fault or failure of equipment, software, hardware, networks, epidemic,
pandemic or widespread outbreak of illness, then I will contact the client as
soon as possible to let them know and I will take steps to minimize the effect
of the delay. Provided I do this I will not be liable for failure or delays
caused by the event, but if there is a risk of substantial delay The Client may
contact me to end the contract and receive a refund for any goods or services
they have paid for but not received.
In no event shall the Photographer be liable for any damages, losses, or claims exceeding the total amount paid by the Client for the photography services under this contract, regardless of the cause of action, whether arising from contract, tort, negligence, or otherwise. The Photographer shall not be held liable for any damages resulting from unforeseen circumstances, acts of third parties, or major events beyond their reasonable control.
ARCHIVING: The photographs may be destroyed or archived at
my discretion, after the expiration of the applicable ordering period referred
to in these Terms and Conditions.
INTELLECTUAL PROPERTY RIGHTS: I will be the first owner of
any copyright in the photographs, under section 11 of the Copyright, Designs
and Patents Act 1988, as the author of the artistic works that are the photographs.
As such, you are not permitted to amend, edit or sell any of the images
provided to you.
